Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Pathbreak Ltd (trading as Pathbreak), a company registered in England and Wales (company number 17265710), with a registered office at 60 High Street, Wimbledon, London, England, SW19 5EE ("Pathbreak", "we", "us"). By accessing pathbreak.io (the "Site") or using the Pathbreak platform (the "Service"), you agree to these Terms. If you are agreeing on behalf of an organization, you confirm you have authority to bind that organization.

2. The Service

Pathbreak is an agentic cloud security platform that discovers, validates, and helps remediate attack paths across cloud environments, alongside security findings and compliance mapping. The Service is currently offered in private preview. It may change, be limited, or be discontinued, and it is provided on an "as is" and "as available" basis during this period.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity that occurs under your account. Notify us promptly at [email protected] of any unauthorized use.

4. Authorization to connect your environment

The Service connects to the cloud environments you choose and analyzes their configuration, identity, and related metadata to validate attack paths. It does not exploit vulnerabilities or modify your resources. This is a critical term:

  • You represent and warrant that you own, or are explicitly authorized to connect and assess, every cloud account, tenant, subscription, and resource you connect to the Service.
  • You grant Pathbreak permission to access and analyze those environments for the purpose of providing the Service.
  • You are responsible for obtaining any internal approvals and third-party or cloud-provider consents required before connecting an environment.
  • You must not connect or direct the Service at any system you do not own or are not authorized to assess.

5. Acceptable use

You agree not to misuse the Service, including by: using it against systems without authorization; attempting to access another customer's data; reverse engineering, reselling, or circumventing access controls except as permitted by law; interfering with the Service's operation; or using it to violate any applicable law or the terms of your cloud providers.

6. Customer data and privacy

Our handling of personal data is described in our Privacy Policy. You retain ownership of the configuration, findings, and other data generated from your environment. You grant us the limited rights needed to operate and improve the Service, subject to the Privacy Policy. Pathbreak and Pwned Labs are separate companies with separate ownership, and Pathbreak's technology is independently developed. We do not use Pwned Labs' data, content, code or materials to build or train Pathbreak.

7. Intellectual property

The Service, the Site, and all related software, content, and trademarks are owned by Pathbreak or its licensors and are protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service during the preview. No other rights are granted.

8. Confidentiality

Each party may receive non-public information from the other. The receiving party will protect it with reasonable care and use it only to perform under these Terms, except where disclosure is required by law.

9. Fees

Access during private preview may be provided at no charge or under a separate written agreement. Any future paid plans, and their pricing and billing terms, will be communicated before they apply to you.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Automated analysis has inherent limits; while we design the Service to operate safely, we do not warrant that it will be error-free, uninterrupted, or that it will identify every vulnerability or attack path.

11. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud). [Confirm liability cap with counsel.]

12. Indemnification

You will indemnify Pathbreak against claims arising from your breach of these Terms, your misuse of the Service, or your connection of environments you were not authorized to assess.

13. Term and termination

These Terms apply while you use the Service. Either party may end the arrangement at any time during the preview. We may suspend or terminate access if you breach these Terms or to protect the Service or its users. On termination, your right to use the Service ends.

14. Changes

We may update these Terms or the Service from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory local law provides otherwise.
